Licensed Application End User License Agreement

1. Scope of License

The Application Provider grants you a limited, non-exclusive, non-transferable, revocable license to use TCG for personal, non-commercial purposes on any product you own or control, subject to the terms of this Agreement, Apple's Standard EULA, and the TCG Terms of Service and Privacy Policy.

You may not:

• Modify, decompile, reverse engineer, or create derivative works based on TCG
• Share, sublicense, rent, lease, or sell the application
• Bypass any functionality or restrictions imposed by the Application Provider or Apple
• Use TCG for any unlawful or harmful activity

All rights not expressly granted to you are reserved by the Application Provider.

2. Consent to Data Practices

You acknowledge that your use of TCG involves the collection and processing of certain data, as outlined in the TCG Privacy Policy. Key practices include:

• Storage of your phone number in Google Firebase for authentication
• Creation of a User ID to enable pseudonymous participation
• Use of de-identified discussion data for analytics via OpenAI, LLC
• Retention of data only for the minimum time required, with daily erasure of expired discussion text
• No sale or sharing of personal information with advertisers or marketers

Your use of the app constitutes consent to these practices.

3. Ownership and User Content

All software, visual interfaces, trademarks, and content in TCG are owned by or licensed to the Application Provider. You retain ownership of your own content but grant the Application Provider a worldwide, royalty-free license to host, analyze, and display it for service operations, moderation, and aggregated insights. Content may be removed for violations of community guidelines.

4. Termination

This Agreement is effective until terminated by you or the Application Provider. Your rights under this license will terminate automatically without notice if you fail to comply with any provision. Upon termination, you must cease all use and delete the app from your devices.

5. Disclaimer of Warranty

TCG is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Application Provider does not guarantee that the Licensed Application will be uninterrupted or error-free.

6. Limitation of Liability

To the maximum extent permitted by law, the Application Provider shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of or inability to use the Licensed Application. Total liability for all claims in any 12-month period is limited to $10 USD.

7. Governing Law

This Agreement shall be governed by the laws of the State of California and applicable U.S. federal law. Any dispute arising from this Agreement shall be subject to binding arbitration as described in the TCG Terms of Service.
